Please read these Terms of Service ("Terms") carefully before using Modified ("Service"), operated by Foundation X LLC ("Foundation X," "we," "our," or "us"). By submitting your website for a preview or using any feature of the Service, you agree to these Terms. If you do not agree, do not use the Service.
Foundation X LLC is a Utah limited liability company. The Service is a website conversion, hosting, and AI-assisted editing platform operating at modified.site.
You represent and warrant that you own, or have the legal authority to modify and host, any website you submit to the Service. Submitting a website URL is your attestation that you have the right to authorize the preview, conversion, hosting, and editing of that site's content. Foundation X relies on this representation and may require domain ownership confirmation (see Section 9).
If you submit a website you do not own or are not authorized to modify, you are solely responsible for any resulting claims, damages, or legal liability.
The Service allows you to request a free preview conversion of your website, try AI-assisted edits on the preview, and subscribe to a paid plan to go live with a hosted, managed site. We reserve the right to decline any request at our discretion.
Your free preview is a demonstration only and does not constitute a hosting agreement. Free previews expire 72 hours after creation. Previews may be extended through customer activity or upgrade to a paid plan. We will attempt to notify you by email before a preview expires. Foundation X may remove any preview at any time at its discretion.
Paid plan details and pricing are described at modified.site/pricing. All fees are in US dollars. Prices may change; we will notify active subscribers at least 30 days in advance. Edit credits are consumed when the AI or our team applies a change to your site. Credits do not roll over between billing periods unless your plan specifies otherwise. Unused credits at cancellation are forfeited.
Complete Redesign Service: The redesign preview fee and go-live setup fee are described at modified.foundationx.com/pricing. During the founding customer period, these fees may be waived. The redesign preview fee is non-refundable once the redesign is delivered.
You may cancel your subscription at any time through your account or by emailing us. Cancellation takes effect at the end of the current billing period; no partial-period refunds are issued. One-time setup fees are non-refundable after work has begun. We will work with you in good faith if there is a billing error or if the Service failed to deliver what was promised.
Edits applied to your site may be generated by AI (Amazon Bedrock / Anthropic Claude). You are responsible for reviewing AI-generated content. Foundation X is not liable for inaccuracies or errors in AI-generated edits. If an edit does not look right, use the Undo feature or contact us.
You may not use the Service to:
We may require you to verify that you own a domain before building a preview or going live. Verification methods include email-domain matching or placing a DNS TXT record. Failing verification will delay or prevent your preview from being built.
If you believe a preview hosted by Modified contains your content or was built without your authorization, contact us at legal@foundationx.com. We will respond within 5 business days. See our Takedown Policy for the full process.
We collect and process information as described in our Privacy Policy, which is incorporated into these Terms.
Your website's content remains yours. Foundation X does not claim ownership of content we convert or host. You grant us a limited license to store, display, and modify your content solely to provide the Service.
You agree to defend, indemnify, and hold Foundation X and its officers, employees, and agents harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your submission of content you did not have the right to submit; or (d) your violation of any law or the rights of a third party.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOUNDATION X IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR $100, WHICHEVER IS GREATER.
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED EDITS WILL MEET YOUR REQUIREMENTS.
These Terms are governed by the laws of the State of Utah, USA. Any dispute will be resolved in the courts of Utah County, Utah.
We may update these Terms at any time. We will notify active subscribers by email at least 14 days before material changes take effect. Continued use of the Service after changes constitutes acceptance.
